The duration of your stay in Australia on the TSS visa ranges from one to four years, depending on your nominated occupation, the visa stream you are applying under, and your personal circumstances. Different Streams

The Temporary Skill Shortage visa (subclass 482) offers three streams for overseas skilled workers:


  • Short-term stream:

This stream allows your employer to sponsor you on a temporary basis for occupations listed on the Short-term Skilled Occupation list (STSOL) for the TSS visa. It can be used to fill positions for a maximum of two years or four years if there is an International Trade Obligation (ITO) in place.


  • Medium-term stream:

The medium-term stream enables your employer to sponsor you for periods of up to four years for occupations listed on the Medium and Long-term Strategic Skills List (MLTSSL) or the Regional Occupation List (ROL) for the TSS visa.


  • Labour agreement stream:

If your employer has entered into a labor agreement with the Department, this stream allows them to sponsor you as an overseas worker.

Requirements

Short-term stream:

To be eligible for a visa under this stream, you must meet the general requirements mentioned earlier, and in addition:

  • Have a minimum of two years of work experience in your nominated occupation or a related field.
  • Demonstrate that you are a genuine applicant seeking entry and stay in Australia for short-term purposes, known as a ‘Genuine Temporary Entrant’ (GTE).
  • Intend to work directly for your sponsor or an associated entity of your sponsor, unless the nominated occupation is exempt from this requirement.

Medium-term stream:

To qualify for a visa under this stream, you need to fulfill the general requirements stated previously, along with the following:

  • Possess a minimum of two years of work experience in your nominated occupation or a related field.

Plan to work directly for your sponsor or an associated entity of your sponsor, unless the nominated occupation is exempt from this requirement.


Labour agreement stream:

For a visa under this stream, in addition to the general requirements mentioned before, you must:

  • Be nominated in an occupation included in a labor agreement that your employer has made with the Department.
  • Have at least two years of work experience in your nominated occupation or a related field, unless it is not required as per the terms of the labor agreement.


Visa Information:


The TSS visa is designed for skilled workers seeking temporary employment in Australia. The application process involves three steps:


Step 1: The employer submits a sponsorship application.

Step 2: The employer nominates the skilled position.

Step 3: The proposed employee applies for the visa.


The steps must be completed sequentially, but there is no need to wait for each application’s approval before moving to the next step.



Permitted Activities: With the TSS visa, you can travel to and from Australia throughout the visa’s validity period. As the primary visa holder, you can work for an approved sponsor in your nominated occupation. Family members can also work and study in Australia under this visa.


Location of Application: You have the flexibility to apply for the TSS visa while either inside or outside Australia. However, certain conditions apply if you are applying for another Short-term stream TSS visa within Australia. Specifically, you must not have held more than one Short-term stream TSS visa, and you must not have been in Australia when applying for your most recent TSS visa, unless it aligns with an ITO (International Treaty Obligation). If you are in Australia during the application, you need to hold a substantive visa, a subclass 010 (Bridging A) visa, a subclass 020 (Bridging B) visa, or a Subclass 030 (Bridging C) visa.


Applicants with a “no further stay” condition on their substantive visa might still be eligible to apply for the TSS visa in specific circumstances without formally requesting a waiver. This applies if they have a genuine intention to apply for certain other visas, such as:

  • General Skilled Migration, Subclass 132 (Business Talent),
  • Subclass 186 (Employee Nomination Scheme),
  • Subclass 187 (Regional Sponsored Migration Scheme),
  • Subclass 188 (Business Innovation and Investment (Provisional)), or
  • Subclass 482 (Temporary Skill Shortage) visas.

This is allowed under Regulation 2.05.


Costs: For the visa applicant (nominee), the costs are as follows:


  • Short-term stream applicants: starting from AUD 1150
  • Medium-term and Labour agreement stream applicants: starting from AUD 2400


It’s important to note that your employer is responsible for covering the expenses associated with the sponsorship and nomination applications; these costs should not be passed on to you.


Additional Family Members:


If you are bringing additional family members to Australia, there is an additional fee applicable for their visa.


Other Costs: You may also need to bear other costs, such as health assessments, police certificates, or other certificates or tests as required. Ensuring that these arrangements are made is your responsibility.


Nomination for Overseas Worker

Existing approved sponsors or those applying to become an approved sponsor can nominate an overseas worker for a specific position within their organization.

Cost: The nomination fee for this process is AUD 330. It is essential to submit all required documents and make the payment for the nomination fee during the application.


Nomination Duration: Typically, your nomination is valid for a period of up to 12 months from the date of approval or until the earliest occurrence of the following events:


  • The day the nominated overseas worker is granted a TSS visa.
  • The day the written notification to withdraw your nomination application is received by the authorities.
  • Three months after the ceasing date of your standard business sponsorship, unless a new sponsorship application was lodged before that date and it remains pending.
  • The day your approval as a sponsor is canceled.
  • The day your labor agreement comes to an end.

457 Visa Sponsorship:

To become a sponsor, employers must obtain approval from the Department of Immigration and Border Protection. The key requirements for sponsorship are as follows:

Lawful Business Operation: Provide evidence of an Australian Business Number (ABN) and Business Name Registration.

Demonstrate the legitimacy of business operations through documents like accounting reports, business plans, lease agreements, and employment contracts.

Training Benchmarks: Companies operating for 12 months or more must meet either Training Benchmark A or Training Benchmark B:

  • Training Benchmark A: Contribute 2% of the company’s recent 12-month payroll to an industry training fund operating in the same industry.
  • Training Benchmark B: Allocate 1% of the company’s payroll to train Australian citizens or permanent resident employees of the business.

Companies operating for less than 12 months need to present a verifiable plan outlining how they intend to meet either of the training benchmarks. This plan should be supported by a comprehensive business plan.

Newly Established Business: If your business is recently established, you must provide evidence of its operation.

It’s important to note that there are additional requirements besides the ones mentioned above to become a sponsor, but the ones listed are the main and significant ones.

Visa Nomination The employer is required to nominate a specific position for the skilled worker they intend to hire. The primary criteria to fulfill are as follows:

Minimum Salary Requirement: The position must offer a minimum salary of $53,900.

Occupation on the Short-term Skilled Occupation List (STSOL): The employment position must be listed on the Short-term Skilled Occupation List (STSOL).

Genuine Position: The employer must provide evidence demonstrating that the nominated position is genuine and necessary for their business operations. This ensures that the position is not created solely for the purpose of obtaining a visa and that there is a genuine need for the skilled worker to fill the role.


Visa Application

The final step in the process is the visa application, following the approval of sponsorship and nomination. During this stage, the visa applicant submits their relevant documents to the authorities.

The main criteria for the visa application include:

Skills Assessment:

457 Visa Changes

The changes to the 457 visa program will be implemented in stages, with the complete abolition of the 457 visa and the introduction of the TSS visa taking effect from March 2018. The TSS visa will consist of two streams: the Short-Term stream, valid for up to two years, and the Medium-Term stream, valid for up to four years.

Effective from 19 April 2017, the current 457 visa will undergo the following changes:

  • The occupation lists will be reduced from 651 to 435 occupations. This means that 216 occupations will be removed, and access to 59 other occupations will be restricted.
  • Out of the 435 occupations, 24 will be restricted to regional Australia, primarily related to farming and agriculture.
  • The current Consolidated Sponsored Occupation List (CSOL) will be replaced by the new Short-term Skilled Occupations List (STSOL).
  • The Skilled Occupations List (SOL) will be replaced by the new Medium and Long-term Strategic Skills List (MLTSSL).
  • The Short-term Skilled Occupations List (STSOL) will be updated every 6 months.

The duration of 457 visas will be as follows:

  • 2 years maximum for occupations listed on the Short-term Skilled Occupations List (STSOL).
  • 4 years maximum for occupations listed on the Medium and Long-term Strategic Skills List (MLTSSL).

Effective from 1 July 2017, the following changes will be made to the current 457 visa:

  • The Short-term Skilled Occupations List (STSOL) and Medium and Long-term Strategic Skills List (MLTSSL) will undergo review and may be revised.
  • The English language exemption for applicants earning over $96,400 will be removed, and all applicants will be required to meet the English language requirement.
  • The training benchmark requirement will be expressed more clearly in the legislation.
  • Applicants will be required to provide penal clearance certificates.
  • By 31 December 2017:
  • The Department will ensure that 457 visa holders are paid at the level of their nominated salary and not less by collecting Tax File Numbers and matching them with Taxation Office records.
  • The Department will publicly post a list of sanctioned sponsors who fail to meet their legislative obligations.
