Student Guardian Visa (Sub class 580)

Student Guardian Visa

(Sub class 580)

The Student Guardian visa (subclass 580) is designed for international students studying in Australia who are under 18 years of age and may require a guardian. In some exceptional cases, even students over 18 years old may need a guardian for religious or cultural reasons. This visa allows foreign nationals to apply and stay in Australia as the guardian of a student studying there.

The application for the Student Guardian visa can be lodged concurrently with the student’s visa application or after the student has already arrived in Australia.

Visa Benefits

If you are granted the Student Guardian visa (subclass 580), the following conditions apply:

  • Length of Stay: You can live in Australia for the same duration as the student you are acting as a guardian for, or until the student reaches 18 years of age, whichever comes first.

  • Dependent Children: You can bring dependent children with you to Australia, but they must be under six years of age and meet specific eligibility requirements.

  • Study: You are allowed to study in Australia for a period of up to three months. However, if you intend to study for more than three months, you must apply for a separate student visa.

Important Restrictions:

  • Other Family Members: You cannot bring other family members to Australia, except for dependent children under six years of age who meet the eligibility criteria.

  • Work Permission: As a Student Guardian visa holder, you are not permitted to work in Australia.

It is crucial to adhere to the conditions and limitations of your visa to maintain your lawful status in Australia. If you have any specific questions or concerns about your visa, it’s recommended to consult the official Australian Government website or seek advice from a qualified migration agent.

Eligibility Requirements:

To be eligible for a Student Guardian visa (subclass 580) in Australia, the child you will be guardian for must be above six years of age. The parent, legal custodian, or a relative of the student must nominate you as their guardian, and if you are the parent or legal custodian, you can nominate yourself as the guardian.

As an applicant for the Student Guardian visa, you must meet the following criteria:

  • Relationship: You should be a parent, legal custodian, or relative of the student you will be guarding.

  • Age: You must be at least 21 years old.

  • Support: You should be capable of providing accommodation, general welfare, and financial support to the student.

  • Financial Means: You must have the financial means to support yourself and the student during your stay in Australia.

  • Health Insurance: You need to have health insurance in the form of Overseas Visitor Health Cover for yourself and any dependent child included in your application, valid for at least the first year of your stay. You must provide a receipt or other proof of your health insurance payment along with your visa application.

Additionally, as with other visa applicants, Student Guardian visa applicants must also meet health and character requirements to be granted the visa.

It’s essential to thoroughly review the specific requirements and guidelines on the official Australian Government website for the most up-to-date and accurate information before applying for the visa.
